Sheriff to rule on Rosepark tragedy

THE findings of an inquiry into a care home fire that claimed the lives of 14 elderly residents will be published today.
The tragedy at the Rosepark home in Uddingston, Lanarkshire, in January 2004, after fire broke out near a linen cupboard, also left four people injured.

The outcome of the fatal accident inquiry, the longest in Scottish legal history, is due to be published this morning.

It will try to establish the cause of the fire, as well as look at whether reasonable precautions could have been taken to prevent the deaths and identify any safety defects.

The hearings began in November 2009 and did not conclude until February this year, when final submissions were heard at Hamilton Sheriff Court.

Sheriff Principal Brian Lockhart’s report will sum up 141 days of evidence, contained in 145 files filled with documentary evidence. Some 212 witnesses gave evidence at the inquiry, including several relatives of the victims.

At the end of the final submissions, the sheriff said the main purpose of the inquiry was to ensure lessons were learned for the future.

Previous legal action against the owners of the care home have not resulted in any convictions.

A spokesman for the owners of Rosepark Care Home said: “Our legal team is studying the determination issued by Sheriff Principal Brian Lockhart.”
